1) Agreement to Terms

By accessing or using this website (“Site”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Site.

2) Informational Use Only (No Medical or Crisis Advice)

Content on the Site is for educational and informational purposes only. It is not medical advice, diagnosis, treatment, or a substitute for professional care. Viewing the Site or contacting us does not create a therapist-client relationship.

If you are in crisis: Call or text 988, visit 988lifeline.org, or dial 911. Do not use the Site, contact forms, or email for emergencies.

3) HIPAA & Clinical Services

Information created or received in the course of psychotherapy is Protected Health Information (PHI) governed by HIPAA and our Notice of Privacy Practices available via the SimplePractice client portal. If any Site content conflicts with the HIPAA Notice, the HIPAA Notice controls.

4) Telehealth & Licensure

Psychotherapy services are provided to clients physically located in Massachusetts at the time of service, unless otherwise permitted by applicable law and licensure rules.

5) Eligibility & Appropriate Use

You must be at least 18 years old to use the Site. You agree not to:

  • Use the Site for unlawful purposes or to transmit malware or harmful code;

  • Attempt to gain unauthorized access to systems or data;

  • Scrape, crawl, or harvest content or data (beyond standard browser use);

  • Impersonate any person or misrepresent your affiliation;

  • Interfere with Site security or operation.

We may suspend or restrict access for violations.

6) Intellectual Property

All text, graphics, logos, images, and other materials on the Site are owned by us or our licensors and protected by U.S. and international laws. You may not copy, reproduce, distribute, display, or create derivative works without our written permission.
Trademarks: KDM Psychotherapy PLLC and Therapy with Kat Montague, LICSW are trade names of our practice.

7) Third-Party Services & Links

The Site may link to or integrate third-party services (e.g., SimplePractice for the client portal, scheduling, analytics, video platforms). Those services have their own terms and privacy policies. We are not responsible for third-party sites, content, or practices.

8) Communications; No Emergency Messaging

Email and website forms may not be fully secure. Do not include confidential or emergency information. Once you become a client, please use the client portal for sensitive communication when possible.

9) Disclaimers (Site Provided “As Is”)

The Site is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, secure, or continuously available.

10) Limitation of Liability

To the fullest extent permitted by law, KDM Psychotherapy PLLC, its owner(s), and employees are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Site or these Terms. Our total liability for any claim related to the Site shall not exceed $100.

11) Indemnification

You agree to indemnify and hold harmless KDM Psychotherapy PLLC, its owner(s), and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or violation of these Terms.

12) Privacy

Your use of the Site is also governed by our Privacy Policy. For PHI, see our Notice of Privacy Practices in the client portal.

13) Governing Law & Venue

These Terms and any dispute arising out of or relating to the Site are governed by the laws of the Commonwealth of Massachusetts, without regard to conflicts of law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Plymouth County, Massachusetts.

14) Changes to the Site or Terms

We may modify or discontinue the Site (in whole or in part) at any time. We may update these Terms by posting a revised version with a new Effective date. Your continued use of the Site after changes constitutes acceptance.

15) Severability; Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy, are the entire agreement regarding your use of the Site.
